Sealed Sample

Sealed Sample refers to a physical sample that, after confirmation by both buyer and seller, is jointly sealed and signed by both parties or sealed and signed by one party and acknowledged by the other, serving as the quality basis for future delivery. Usage scenarios: commonly used in industries that trade by sample, such as apparel, footwear, toys, and hardware, to confirm quality standards before bulk production and avoid delivery disputes. Precautions: the sealed sample should be made in duplicate or triplicate, with each party keeping one copy, and if necessary, a third party (such as a commodity inspection agency) should retain one; the sealed sample should be marked with product name, specifications, date, and signatures or seals of both parties; if sent by courier, keep the shipping receipt. Difference from 'Original Sample': the original sample is the reference sample initially provided by the seller, while the sealed sample is the quality benchmark finally confirmed and sealed by both parties. Difference from 'Keep Sample': a keep sample is a sample kept unilaterally, while a sealed sample has contractual effect between both parties. Difference from 'Counter Sample': a counter sample is a sample copied by the seller after the buyer provides the original sample and submitted to the buyer for confirmation, and once confirmed, it may also serve as a sealed sample. Once the sealed sample is confirmed, the seller's delivery must conform to it; otherwise, it constitutes a breach of contract.
