Guarantee Reinstatement

Guarantee Reinstatement refers to the act, in international trade or engineering contracting, where after a guarantee has been partially or fully drawn upon by the beneficiary due to a claim, the applicant (usually the contractor or seller), in accordance with the contract or mutual agreement, restores the guarantee amount to the original or agreed amount through the bank. It is commonly seen in advance payment guarantees, performance guarantees, etc. Usage scenarios: If the beneficiary claims part of the guarantee amount due to the applicant's breach, but the contract continues to be performed, the applicant needs to reinstate the guarantee amount to maintain the guarantee's validity. Notes: Reinstatement usually requires the beneficiary's consent and may require the applicant to provide additional margin or counter-guarantee; reinstatement may involve extra fees. Unlike 'guarantee extension', which focuses on the validity period, reinstatement focuses on the amount; opposite to 'guarantee cancellation', reinstatement maintains the guarantee's validity. The difference is that guarantee reinstatement does not change the guarantee terms, only restores the amount.
