Power of Attorney (POA)

A Power of Attorney (POA) is a common legal document in foreign trade, referring to a written authorization by which a principal (usually an importer/exporter) grants an agent (such as a freight forwarder, customs broker, or lawyer) the authority to handle specific matters on their behalf. Use cases include: customs declaration, customs clearance, cargo pickup, issuance of bills of lading, handling customs inspections, and applying for tax refunds. Precautions: A POA must clearly specify the scope of authorization, validity period, agent information, and the principal's signature and seal; otherwise, it may be rejected by customs or shipping lines. Unlike a 'letter of authorization,' a POA emphasizes legal agency rights and typically requires notarization or authentication; unlike an 'agency agreement,' a POA is a unilateral authorization, whereas an agency agreement is a bilateral contract. In foreign trade, a POA is often used for cargo pickup by a destination port agent or for export customs declaration. Improper authorization may lead to cargo detention or legal disputes, so it is recommended to use a formal template and keep a copy.
