Sale by Drawing

Sale by Drawing is a method of sale in international trade where the quality of goods is based on drawings, design blueprints, or technical specifications provided by the seller. It is suitable for goods whose quality is difficult to describe in words or fully express by samples, such as machine parts, castings, forgings, molds, and handicrafts. Under this term, the seller must produce according to the drawings, and the buyer must confirm the drawings and inspect the goods accordingly. Precautions: The drawings should be detailed and accurate, and attached to the contract as an annex; the ownership of intellectual property rights in the drawings should be clarified; once the buyer confirms the drawings, they may not be modified arbitrarily, otherwise it may constitute a breach of contract. The difference from sale by sample is that sale by sample uses a physical sample as the quality standard, while sale by drawing uses written technical drawings as the standard; the difference from sale by specification is that sale by drawing focuses more on graphical information such as structure, dimensions, and materials, rather than mere textual parameters. When using this term, the version of the drawings, modification procedures, and inspection methods should be agreed upon to avoid disputes.
