Guarantee Receipt Method

Guarantee Receipt Method refers to an operational practice in international trade where, when the buyer or seller requires a bank guarantee as payment or performance security, the beneficiary, upon receiving the original guarantee, confirms receipt by signing a Receipt Acknowledgment and undertakes to exercise rights in accordance with the guarantee terms. This term is commonly used in large equipment procurement, engineering project contracting, long-term supply contracts, and especially in scenarios involving advance payment guarantees, performance guarantees, or quality guarantees. The key point of using this method is that once the beneficiary signs for receipt of the guarantee, it is deemed to have accepted the guarantee terms. Therefore, before signing, the guarantee content (such as amount, validity period, claim conditions, applicable law, etc.) must be carefully checked to avoid inability to claim due to non-conforming terms. Unlike the 'Guarantee Notification Method,' which merely refers to the bank notifying the beneficiary of the guarantee matter, the 'Guarantee Receipt Method' emphasizes the beneficiary's active confirmation of receipt and being bound by it. Precautions include: the receipt acknowledgment should clearly state the guarantee number, amount, issuing bank, and date, and a copy should be retained; if the terms are incorrect, amendments should be requested before signing, and never sign blindly. In addition, the guarantee receipt method may affect the subsequent claim time limit, so it is recommended to establish a ledger to track the validity period after signing.
