Beneficiary Claim

Beneficiary Claim refers to a claim made by the beneficiary of a letter of credit (usually the exporter) against the relevant responsible party in international trade, after submitting documents, due to refusal, delayed payment, or unreasonable deduction by the issuing bank or importer. Main scenarios include: unreasonable refusal of documents under a letter of credit, bankruptcy or delay in payment by the issuing bank, refusal by the importer based on cargo quality issues without valid grounds, etc. Precautions: The beneficiary must file the claim within the limitation period (usually a reasonable time after refusal) and retain complete documents and communication records; the claim may be directed at the issuing bank, importer, or insurance company, and must be determined according to the contract and letter of credit terms. Difference from other terms: Beneficiary Claim is different from 'Beneficiary's Certificate,' which is a document issued by the beneficiary; it is also different from 'Export Claim,' which is broader and includes disputes over cargo quality, quantity, etc. Beneficiary Claim focuses more on asserting rights in the payment stage of the letter of credit.
