Guarantor

A guarantor in foreign trade refers to a third party that provides assurance for the payment or performance obligations of a debtor (such as an importer, exporter, or borrower). When the debtor fails to fulfill contractual obligations, the guarantor must assume the corresponding payment or compensation liability. Common scenarios include: letter of credit issuance applications, usance payment guarantees, performance guarantees, advance payment guarantees, and credit guarantees in open account transactions. Notes: A guarantor typically needs good creditworthiness; the guarantee liability may be joint and several or general; the scope, duration, and currency of the guarantee must be clearly stipulated, and applicable law and dispute resolution clauses should be noted. Differences from other terms: A guarantor is different from a 'Confirming Bank,' which adds confirmation to a letter of credit; it is also different from an 'Applicant,' who is the buyer requesting the issuance of a letter of credit. A guarantor can be a bank, insurance company, or parent company, etc.
