Customs Recordal

Customs Recordal refers to the process whereby an intellectual property rights holder files an application with the General Administration of Customs to record their trademark, patent, copyright, etc., so that Customs can proactively identify and detain suspected infringing goods during import and export. Usage scenario: When an enterprise owns its own brand or authorized intellectual property and wishes to prevent counterfeit goods from being imported or exported, it needs to complete customs recordal. After recordal, Customs can proactively suspend the release of suspected infringing goods during supervision and notify the rights holder. Notes: The recordal is valid for 10 years and can be renewed; rights proof, cargo information, etc. must be provided; recordal is not mandatory, but without it Customs cannot proactively detain goods and can only detain upon application. Difference from other terms: Customs recordal is different from 'Customs IP Protection', which is a broader legal system, and recordal is one type of proactive protection measure within it; it is also different from 'Customs Declaration Registration', which refers to the registration of an enterprise's customs declaration qualifications. Foreign trade practitioners should attach importance to recordal to protect their rights at low cost.
