Guarantee Expiry Condition is a key clause in bank guarantees or standby letters of credit, referring to the specific conditions under which the guarantee ceases to be effective. It typically includes a fixed expiry date, the occurrence of a specific event (such as completion of contract performance or passing of acceptance inspection), or the submission of a written release notice by the applicant/beneficiary. It is commonly used in international engineering contracting, bulk commodity trading, shipbuilding, and other fields requiring performance guarantees. Precautions: The expiry conditions must be clear and operable, avoiding vague wording that may lead to disputes; if triggered by an event, the supporting documents and submission method should be specified; also attention should be paid to whether the guarantee is automatically extendable or requires manual cancellation. Unlike 'Guarantee Validity Period,' which refers only to the time limit, expiry conditions emphasize triggering events; compared with 'Guarantee Release,' expiry conditions focus on automatic termination, while release requires active action. Properly setting expiry conditions can prevent the guarantee from remaining effective indefinitely, reducing the applicant's capital occupation and risk.
